GST notice generated in time but uploaded late due to portal glitch is time-barred
In Sikka Motors Pvt. Ltd., the notice for FY 2019-20 had to issue by 31 May 2024 under section 73 but reached the portal only in August 2024. The Court held that generating a notice internally is not enough; it must be communicated under section 169 within the limitation period.
What it means: Taxpayers can challenge section 73 notices and orders where the portal upload or communication happened after the deadline.
INJudgmentDelhi High CourtSection 74 GST demand fails if fraud allegations don't name suppliers and transactions
In Treco Wire India Pvt. Ltd., an order confirmed an ITC demand of about Rs 3.34 crore with equal penalty under section 74. The Court held that simply repeating allegations of fraud or suppression is not enough; the order must identify the suppliers, transactions and facts behind them.
What it means: Businesses facing section 74 fake-ITC demands can challenge orders that lack specific factual particulars.
INJudgmentDelhi High Court₹38.47 crore disallowance u/s 40(a)(ia) deleted — Form 26A delayed by portal glitches
The Bangalore Bench deleted a disallowance of about ₹38.47 crore under Section 40(a)(ia), accepting that Form 26A was filed late because of technical problems on the income-tax portal.
What it means: File Form 26A promptly where the payee has paid tax, and keep evidence of portal errors.
INJudgmentITAT BangaloreRetrospective JAO–FAO amendment struck down
The High Court struck down the retrospective amendment concerning the jurisdictional and faceless assessing officer framework for reassessment notices.
What it means: Reassessment notices issued by the JAO rather than the faceless unit may be open to challenge.
INJudgmentPunjab & Haryana High CourtForm 26AS mismatch alone can't justify a rental income addition
A difference between Form 26AS and the return is not, by itself, enough to add rental income; the Tribunal directed a year-wise reconciliation.
What it means: Reconcile 26AS and AIS with your books every year and keep the working.
INJudgmentITAT MumbaiRevaluation surplus taxable in the firm's hands u/s 45(4)
On reconstitution of a partnership, tax on revaluation surplus under Section 45(4) falls on the firm, not on the retiring partners.
What it means: Plan partner exits and reconstitutions before the deed is signed.
INJudgmentITAT AhmedabadBank trail alone not conclusive for Section 68
The Tribunal set out a more detailed test for cash credits under Section 68, holding that a banking trail by itself does not establish genuineness.
What it means: For loans and share capital, document identity, creditworthiness and genuineness — not just bank statements.
INJudgmentITAT MumbaiEx parte GST order set aside — try other modes of service
Where notices uploaded only on the GST portal drew no response, the officer should have used other modes of service and offered a hearing; the ex parte assessment was set aside.
What it means: Check the GST portal's notices section regularly.
INJudgmentMadras High CourtGST clarified on sublimation paper, toys, used-car dealers' ITC and seaweed bio-stimulants (Circular 265)
Following the 57th GST Council meeting, CBIC classified sublimation paper under heading 4809 at 18% and said the reduced toy entries cover all heading 9503 toys, not only wheeled ones (5% non-electronic, 18% electronic). Used-vehicle dealers under the margin scheme can take ITC on inputs and services other than the second-hand vehicles, and seaweed-based bio-stimulants registered under the Fertiliser Control Order fall under heading 3101.
What it means: Past classification disputes on paper and bio-stimulants are regularised on an 'as is where is' basis, and used-car dealers can now claim ITC on overheads like repairs, rent and marketing.
INCircularCBICGST on R&D grants, vehicle leasing, bank FTP interest and NBFC co-lending clarified (Circular 266)
CBIC said a certificate from the head of the grant-receiving institution can support the GST exemption for R&D (not consultancy) services. Recoveries like road tax, insurance and FASTag by a vehicle lessor are part of the leasing supply, notional interest under banks' fund transfer pricing counts as exempt interest, TRAI is not 'Government', and NBFC services to banks under co-lending are taxable.
What it means: Research bodies, leasing firms, banks and NBFCs get clarity that should reduce disputes, and foreign shipping lines' related-party imports are exempt from 1 Nov 2026 with past payments regularised.
INCircularCBICCBDT exempts payments to International Rice Research Institute from Chapter XIX (Notification 138/2026)
Using section 400(1) of the Income-tax Act, 2025, CBDT notified that Chapter XIX will not apply to payments received by IRRI. The relief is subject to conditions under the United Nations (Privileges and Immunities) Act, 1947 and the related MEA notification.
What it means: Payers dealing with IRRI should check the notification before applying the Chapter XIX provisions to these payments.
INNotificationCBDTCBDT proposes Rule 281A and Form 173A for G-sec interest and capital gains exemption
CBDT has proposed the Income-tax (Seventh Amendment) Rules, 2026. They add Rule 281A and a new Form 173A for giving information to claim the exemption on interest and capital gains from Government securities under Schedule IV of the Income-tax Act, 2025.
What it means: Eligible investors in Government securities will need to file Form 173A to support their exemption claim once the rules are final.
INNotificationCBDTITC on demo vehicles allowed even for dealers working as manufacturer's agent (Circular 262)
CBIC withdrew para 4.6 of Circular 231/25/2024-GST, which had treated ITC on demo vehicles as blocked under section 17(5)(a) where the dealer only acted as the manufacturer's agent. The new circular says such ITC is not blocked for dealers in the agency model.
What it means: Authorised car dealers using the agency model can now claim GST credit on test-drive vehicles.
INCircularCBICCBIC issues 8 GST circulars: registration timelines, export payment routes, SCN drafting
CBIC issued eight circulars on 26 October 2026 to implement the 57th GST Council decisions. They list standard documents and timelines for registration (about 7 working days with Aadhaar authentication), set guidance on pre-SCN intimation and SCN drafting, and (Circular 263) say export benefits cannot be denied only because proceeds were settled through an RBI-permitted route such as set-off against import payables.
What it means: New applicants should face fewer document demands, and exporters using RBI-approved settlement routes keep zero-rating and refund eligibility.
INCircularCBICGST orders based on omitted Rule 96(10) quashed
The Court set aside GST orders that relied on Rule 96(10) of the CGST Rules. The rule was omitted by Notification No. 20/2024-Central Tax with effect from 8 October 2024 and without a saving clause, so pending proceedings could not continue. The Court followed the Supreme Court in Goodluck India and a CBIC Office Memorandum.
What it means: Exporters facing IGST-refund recovery under Rule 96(10) should have pending notices and orders reviewed.
INJudgmentAllahabad High CourtTata Consumer Products wins on depreciation on intangibles (AY 2020-21)
By order dated 7 October 2026, the Kolkata Bench decided in the company's favour on its claim for depreciation on intangible assets, arising from an AY 2020-21 assessment that had raised a demand with interest.
What it means: Depreciation on intangibles acquired in restructurings remains defensible with proper valuation and acquisition records.
INJudgmentITAT KolkataAmended GST pre-deposit doesn't apply to appeals from SCNs issued before 1 October 2025
In a batch of writ petitions arising from Section 122 proceedings, the Court held that the amended pre-deposit requirement in Section 107(6) of the CGST Act, in force from 1 October 2025, does not govern appeals arising from show cause notices issued before that date.
What it means: Check the notice date before computing pre-deposit on a GST appeal.
INJudgmentDelhi High CourtFake ITC: use the statutory appeal before the writ court
In Mahalaxmi Industries v. Union of India, involving ITC allegedly taken on invoices from non-existent firms, the Court stressed that the appeal under Section 107 of the CGST Act should be pursued before invoking writ jurisdiction.
What it means: File the GST appeal within time even if a writ is being considered.
INJudgmentGujarat High CourtGST appeal limitation runs from actual date of communication
An appellate authority cannot reject a GST appeal as time-barred by counting from the order date when the taxpayer's stated date of communication is not rebutted by the department.
What it means: Keep a record of the date each GST order actually reached you.
