DTAA for NRIs: how to avoid paying tax twice

If you live abroad and earn income in India, two countries may want to tax the same rupee. India's double taxation avoidance agreements (DTAAs) decide who taxes what, and often cut the TDS deducted in India.

What a DTAA does

India has tax treaties with more than 85 countries, including the US, UK, UAE, Canada, Singapore, Australia and Germany. A treaty can help an NRI in two ways:

  • Lower tax in India: treaty rates on interest, dividends, royalties and fees are often lower than India's normal rates, and you may choose whichever is more beneficial.
  • Credit abroad: tax paid in India is usually credited against tax on the same income in your country of residence, so you do not pay twice.

Documents you need to claim treaty relief in India

DocumentWho issues itPurpose
Tax residency certificate (TRC)Tax authority of your country of residenceProves you are a tax resident there for the period
Form 10F (reported as Form 41 from 1 April 2026)You, filed online on the Indian tax portalGives details the TRC may not contain, such as your foreign tax number and address
PANIndian Income Tax DepartmentWithout it, TDS is deducted at higher rates
Self-declaration of no permanent establishment and beneficial ownershipYouOften asked for by banks and payers

Give these to the payer (your bank, tenant or company) before the income is paid, so TDS is deducted at the treaty rate.

Claiming foreign tax credit in India

The reverse also applies. If you are resident in India and paid tax abroad, you can claim a credit in India by filing Form 67 with supporting proof before your Indian return is filed. Missing this step is a common reason credits are refused.

Countries where NRIs most often need help

  • United States: US citizens and green card holders are taxed on worldwide income, so Indian income must be reported in both countries and credits claimed carefully.
  • United Arab Emirates: there is no personal income tax, so a UAE TRC is important to show you are liable to tax there and to avoid being treated as a deemed resident of India.
  • United Kingdom and Canada: rental income and capital gains on Indian property are usually taxable in both countries, with credit for Indian tax.

Checklist

  1. Get a TRC for every year in which you receive Indian income.
  2. File Form 10F/41 online and keep the acknowledgement.
  3. Send TRC, Form 10F/41 and PAN to every Indian payer before they deduct TDS.
  4. Report the Indian income and tax in your country of residence and claim the credit.
